Terms of Service

These Terms of Service ("Terms") govern your access to and use of DreamMoto (dreammoto.az and related apps, the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. The Service

DreamMoto is an online marketplace for motorcycle listings and related content. DreamMoto is not a party to transactions between buyers and sellers unless expressly stated. You are responsible for evaluating listings, sellers, and any purchase or rental decisions.

2. Eligibility and accounts

• You must be legally able to enter a binding agreement in your country.
• You must provide accurate information and keep it updated.
• You are responsible for activity under your account and for keeping OTP codes confidential.
• We may suspend or terminate accounts that violate these Terms or applicable law.

3. Phone and WhatsApp authentication

We may offer sign-in or registration using a one-time code sent to your phone via WhatsApp and/or SMS. By requesting an OTP, you confirm that you own or control the number and consent to receive verification messages. Message and data rates may apply. Delivery depends on Meta WhatsApp, carriers, and your device settings.

4. Listings and user content

• You may only post lawful, accurate listings you are authorized to offer.
• You must not post stolen goods, scams, hate content, malware, or illegal material.
• You grant DreamMoto a non-exclusive license to host, display, and promote your listings as needed to operate the Service.
• We may remove or edit content that violates these Terms or harms users.

5. Payments and promotions

Paid features (for example, premium placement, bumps, or wallet top-ups) are described at the point of purchase. Fees are generally non-refundable except where required by law or expressly stated. Third-party payment processors handle card data under their own terms.

6. Prohibited conduct

• Scraping, reverse engineering, or overloading the Service.
• Impersonation, fraud, or abuse of messaging/OTP systems.
• Circumventing security, rate limits, or access controls.
• Using the Service for spam or unauthorized advertising.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE uninterrupted service, listing accuracy, or successful transactions between users.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREAMMOTO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DREAMMOTO FOR THE SERVICE IN THE 3 MONTHS BEFORE THE CLAIM OR (B) USD 50.

9. Indemnity

You agree to indemnify and hold DreamMoto harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or third-party rights.

10. Changes

We may update these Terms. The "Last updated" date will change when we do. Continued use after changes constitutes acceptance. If you do not agree, stop using the Service.

11. Governing law

These Terms are governed by the laws of the Republic of Azerbaijan, without regard to conflict of law rules, unless mandatory consumer protections in your country require otherwise. Courts in Baku, Azerbaijan shall have jurisdiction, subject to applicable mandatory law.
